Fond du Lac Bumper Exchange, et al. v. Jui Li Enterprise Company, et al.
Plaintiffs in class action lawsuits allege that the defendants conspired to fix and maintain artificially high prices for sheet metal aftermarket auto parts in violation of section 1 of the Sherman Antitrust Act.
Plaintiffs’ Factual Allegations
Plaintiffs allege that defendants control over 95 percent of the United States AM Parts market and that defendants violated section 1 of the Sherman Act by agreeing to set the prices of many AM Parts and to engage in other anticompetitive behavior such as curtailing the number of parts that they manufacture.
Plaintiffs allege that defendants’ agreement and the nsuing anti-competitive conduct caused the prices of many AM Parts sold in the United States to increase significantly.
Proposed Class
The class includes all persons and entities in the United States, and its territories and possessions, that purchased AM Sheet Metal Parts directly from a defendant between at least as early as January 1, 2003 and the present.
Case Status
On November 30, 2010, U.S. District Court Judge Lynn Adelman of the Eastern District of Wisconsin denied defendants' motions to dismiss the complaint. On July 6, 2011, the Court denied defendants' motions to reconsider the November 10, 2010 order.
