Burnham Boiler Product Defects
In November 2010, customers who purchased residential oil-fired boilers filed a class action lawsuit against Burnham Hydronics, Inc. alleging misconduct in connection with the design, manufacture, marketing, advertising, selling, warranting, and servicing of these boilers.
Burnham V7 & V8 Series: Factual Allegations of Block Defect
As set forth in the complaint, plaintiffs allege these Burnham Boilers have a manufacturing defect in the heat exchanger, also known as the “block” or the main component of the furnace. This alleged defect is in the cast iron and causes the furnace block to crack. Over time, the crack enlarges to the point where water drains completely from the system, causing a complete failure of the boiler.
As a result, owners are being forced to either replace the heat exchanger or replace the entire unit at great cost.
Proposed Class
Plaintiffs seek to represent a nationwide class consisting of all individuals who own or owned a Burnham Boiler for primarily personal, family, or household purposes, and not for resale, in Pennsylvania, Connecticut, Maine, New Jersey, and or New York.
Relief Sought
Plaintiffs seek actual damages, equitable relief (including restitution, injunctive relief, and disgorgement of profits), and punitive damages.
