Dell Inspiron 5150 Notebook Computer Complaints Class Action Settlement

Important Update Regarding Dell Inspiron 5150 Notebook Computers

Lieff Cabraser Heimann & Bernstein, LLP, with co-counsel, represents owners of the Dell Inspiron 5150 notebook computer in a class action lawsuit against Dell, Inc.

On September 13, 2006, the United States District Court for the Northern District of California issued an order preliminarily approving a settlement granting relief to a class consisting of all individuals and entities in the United States who own or have owned a Dell Inspiron 5150 notebook computer.

By the end of September 2006, members of the class should receive an official notice explaining the exact terms of the settlement. These terms are subject to final approval by the Court. In general terms, the settlement includes an extended one-year limited warranty for the following "Qualifying Repairs":

  1. Repairs to resolve messaging code M1004, which is a message that the 5150 is programmed to display if it shuts down to prevent system damage;
  2. Heat sink replacements;
  3. AC adapter replacements necessary to resolve "insufficient power" and "cannot identify power source" messages; and
  4. Motherboard replacements that are necessary to resolve "no power" or "shutdown" situations.

This limited warranty will be effective from September 30, 2006 to September 30, 2007.

In addition, class members with proof sufficient to establish that they paid Dell or a third party out-of-pocket for Qualifying Repairs will be entitled to a 100% cash refund from Dell, including any related shipping costs.

This settlement is not related to Dell's August 2006 recall of certain batteries sold with Dell LatitudeTM, InspironTM, XPSTM and Dell Precision Mobile WorkstationTM notebook computers. In cooperation with the U.S. Consumer Product Safety Commission and other regulatory agencies, Dell is voluntarily recalling certain Dell-branded batteries with cells manufactured by Sony and offering free replacements for these batteries. The Inspiron 5150 is not affected by the battery recall.

Please note that this is only a short summary of the settlement terms. Class members should refer to the class action notices they receive for complete information regarding settlement terms and what they can do to participate in the settlement.
