Estratest® and Estratest H.S.® Settlement
Estratest® is a hormone replacement therapy drug manufactured by Solvay Pharmaceuticals, Inc. Solvay manufactured Estratest® and Estratest H.S. starting in 1964, and has recently removed it from the market.
In 2004, plaintiffs represented by Lieff Cabraser Heimann & Bernstein, LLP filed suit claiming misrepresentation and unfair competition under state law on behalf of themselves and consumers nationwide. Plaintiffs alleged that Solvay never had approval to market the drugs from the Food and Drug Administration but, nevertheless, marketed them as being FDA approved.
The case was recently resolved on behalf of a class of anyone who purchased Estratest or Estratest H.S. in any state, other than California, since March 8, 1998. You can read a copy of the Notice of Settlement at the official settlement website. Persons with pending claims against Solvay for personal injury or wrongful death are not included.
The Settlement provides $16.5 million to Settlement Class Members. Purchasers can obtain partial refunds up to 30% of the purchase price paid for Estratest. In order to participate in the Settlement, Settlement Class Members must file a claim form stating their total out-of-pocket expenses for Estratest since March 8, 1998. The Court granted Final Approval of the $16.5M Settlement Fund on March 16, 2010
