Consumer Groups Call for Reversal of Bankruptcy Court's Decision to Exempt Chrysler from Accountability

Leading national consumer groups late Tuesday appealed the decision of the federal bankruptcy court overseeing the Chrysler bankruptcy proceeding, asking the court to preserve consumer protection laws and the rights of victims injured by vehicle design flaws and defects to seek compensation from Chrysler. Chrysler Bankruptcy Could Leave Victims of Defective Vehicles With No Legal Recourse
May 21, 2009
In the bankruptcy proposal, Chrysler would honor warranties and be responsible for recalls of defective vehicles. But victims of poorly designed and defective vehicles would not receive compensation for injuries sustained. For example, Chrysler will not be responsible for any vehicles on the road today once it emerges from bankruptcy. No matter how egregious the defect, Chrysler would have no responsibility for injuries occurring after the bankruptcy in vehicles sold before the bankruptcy. More...

Hearing Highlights Victims' Nightmares with Medical Devices
May 12, 2009
The Supreme Court ruled in Riegel v. Medtronic that because the FDA had approved a medical device through the pre-market approval process, patients injured by medical devices do not have any recourse to hold the manufacturers accountable. The Court ruled a year later in Wyeth v. Levine that patients harmed by prescription drugs can hold manufacturers accountable in state courts, creating a double standard between prescription drugs and medical devices. More...
