October 1, 2008

In a panel discussion between leading securities law attorneys, Lieff Cabraser's Joy A. Kruse discussed the stock options backdating litigation.

In regard to the use of confidential witnesses to bolster allegations in securities fraud complaints, Ms. Kruse commented, "Confidential witnesses can be part of the allegations you make in the complaint if the witnesses are identified as to the position they held in the company in the relevant time period, their background and professional expertise, and why they would be able to assess whatever the issue is."
