San Francisco Chronicle, "Security firm hit with suit; Loss of overtime wages filed in multiple complaints"
A San Francisco law firm Tuesday filed a class-action lawsuit on behalf of current and former employees of Pasadena-based Inter-Con Security Services, charging that the company, which provides security services for Kaiser Permanente, among others, has failed to pay overtime wages.
The complaint, filed in U.S. District Court in San Francisco, charges that Inter-Con is in violation of federal and state labor laws by requiring its security guards to attend 15-minute security briefings prior to each eight-hour shift without paying them for that time. The proposed class-action complaint could cover thousands of workers in California and potentially throughout the United States and could result in millions of dollars in liabilities, said Jahan Sagafi, a lawyer with Lieff Cabraser Heimann & Bernstein.
"If the briefing is part of our job -- and it is -- then we should be paid for it," said Ed Hall, an Inter-Con security officer who has worked at Kaiser's Stockton medical offices since 1999. "Inter-Con calls it mandatory but when it comes down to our paychecks, they consider it voluntary. It's really overtime and we shouldn't be forced to work it for free."
