Long Island pilots Joseph Lepore and Jan Paladino may be home for the holidays, but the investigations and litigation set in motion by the midair collision in Brazil will be continuing into the new year and possibly beyond.
Lexi Hazam of Lieff Cabraser Heimann & Bernstein in San Francisco, which is representing 21 families, said Judge Brian Cogan set tight deadlines for the defendants' attorneys to file motions arguing that the case should not be heard in the United States. Hazam said she expected a decision around May on where the case will be heard. She said that if the case remains in the U.S. court, she expects settlement negotiations to begin to avoid a trial. "It is extremely rare in aviation cases for a case to go to a jury," she said.
