  • Direct Merchants Bank Customer Satisfaction Guarantee Program Begins
As part of the class action settlement with credit card provider Direct Merchants Bank, eligible current cardholders may participate in a Customer Satisfaction Guarantee Program (“CSGP”). The CSGP runs until September 2003. Under the program, current cardholder class members will be able to receive between $10 and $70 to satisfy their claims against Direct Merchants Bank.
  
  • Settlement Reached in Liberty Mutual Auto Insurance Case
On August 20, 2002, a settlement was reached in a consumer protection lawsuit against auto insurance company Liberty Mutual regarding its imitation parts practices. The plaintiff, an auto insurance policyholder, alleged that Liberty Mutual specified the use of non-original equipment manufacture crash parts for policyholders whose vehicles required repairs after an accident or collision.

  • $10 Million Settlement Reached with Perdue Farms in Wage and Hour Case
On August 7, 2002, a $10 million settlement was announced in a class action lawsuit on behalf of 60,000 Perdue Farms chicken processing employees for alleged wage and hour violations. This new settlement is in addition to a $10 million settlement between the U.S. Department of Labor and Perdue announced on May 9, 2002. Under the new settlement, tens of thousands of workers who will not receive money pursuant to the Department of Labor settlement will now receive payments for time spent “donning and doffing,” that is, obtaining, putting on, sanitizing, and removing protective clothing and gear.
James Finberg of Lieff Cabraser, which served as co-lead counsel for the workers, commented, "The chicken plant workers at Perdue Farms are among the most dedicated and hardest working employees in the nation. They deserve to be paid for each and every hour of work they perform. We are gratified to have been able to obtain significant additional compensation for them."   • R.J. Reynolds Tobacco Co. Fined For Marketing To Youth
On June 6, 2002, in a lawsuit filed by California Attorney General Bill Lockyer against R.J. Reynolds Tobacco Company, the California Superior Court found that R.J. Reynolds had sought to avoid losing market share through an aggressive ad campaign that exposed teens to its advertising to the same degree as adult smokers. In 1998, the tobacco industry, including R.J. Reynolds, entered into a settlement agreement which prohibits tobacco advertising that is targeted, directly or indirectly, at youth. The Court ordered R.J. Reynolds to change its marketing practices, and fined the company $20 million. To read a copy of this order (in Adobe Acrobat format), click here.
In the tobacco litigation that resulted in the 1998 settlement, Lieff Cabraser represented 18 cities and counties in California and jointly prosecuted the California tobacco lawsuit with the California Attorney General.
