Toshiba Laptop Screen Flicker Settlement

Lieff Cabraser Heimann & Bernstein, LLP, has negotiated a settlement with Toshiba America Information Systems, Inc. ("TAIS") to provide relief for owners of certain Toshiba Notebook computers ("Covered Models") with screens that tend to flicker or dim.1

Refunds

Under the terms of the Settlement, owners of Covered Models who paid to have the Flicker Issue2 repaired by either TAIS or an authorized TAIS service provider may submit a claim form and a copy of their repair records to recover the cost of that repair, up to $300 for the Satellite 1800 Series and the Satellite Pro 4600 personal computers, or $400 for the Tecra 8100 personal computers (the "Refund"). The date to submit a claim for repair costs expired last year.

Extended Warranty

In addition to the Refund for past repairs, TAIS has agreed to extend the length of the warranty on the Covered Models by 18 months. This means that if your Covered Model displays the Flicker Issue, TAIS will fix it free of charge now and for the next 18 months. The warranty for Covered Models will be extended to May 4, 2006 for LCD repairs required by the FL Inverter Issue only. You do not need to do anything to be eligible for the warranty extension.

If your Covered Model is already out of warranty but displays the symptoms of the Flicker Issue, you may send your computer to TAIS, and it will be repaired at no cost to you if the symptoms are caused by the FL Inverter Issue. 1 "Subject Notebooks" means any of a number of computer models that are subject to the terms of this settlement. Subject Notebooks include the following Toshiba models: Satellite 1805-S177, 1805-S208, 1805-S278, 1800-S274, 1800-S207, 1805-S207, 1805-S154, 1805-S255, 1800-S256, 1800-S206, 1800-S254, 1800-S204, 1805-S274, 1805-S254, 1805-S204, 1805-S273, 1805, 1800, 1800-S253, 1800-S203, 1805-S253, 1805-S203, Satellite Pro 4600 Series, and Tecra 8100. If you purchased a Subject Notebook and incurred out-of-pocket costs to remedy the Flicker Issue, you may be eligible to receive a refund for the cost of repair.

2 "Flicker Issue" refers to the tendency of the LCD screens of Subject Notebooks defined above to intermittently flicker, dim and then go blank.
