Firepot Fuel Gel Recall
Firepot Fuel Gel Recall
Due to burn and flash fire hazards, on September 1, 2011, nine manufacturers of fuel gel for patio and lawn firepots issued a voluntary recall of their pourable gel fuel products. Consumers have been injured in situations where it was not clear whether the flame of the firepot was out.
The U.S. Consumer Product Safety Commission (CPSC) reports 65 incidents ”resulting in two deaths and 34 victims who were hospitalized with second- and third-degree burns of the face, chest, hands, arms or legs.”
From 2008 to 2011, pourable fuel gel was sold by the following companies:
- Bird Brain Inc.
- Bond Manufacturing
- Sunjel Company (2 Burn Inc.)
- Fuel Barons Inc.
- Lamplight Farms Inc.
- Luminosities Inc. (Windflame)
- Pacific Décor Ltd.
- Real Flame
- Smart Solar Inc.
The nine companies who issued the September 2011 recall were preceded by Napa Home & Garden, which issued a fire gel product recall in June 2011.
As The New York Times reports, “Marshall Group of Elkhart, Ind., pulled out of the public announcement at the last minute,” and the CPSC continues to urge the company to issue a recall of its fuel gel products.
Legal Rights of the Injured
The law in most states provides individuals with legal claims and the right to compensation for fire-related injuries they suffer as a result of a defective product or the negligence of another. Burn survivors and other victims of fires may file lawsuits seeking compensation for their pain and suffering, medical expenses, lost past and future wages and punitive damages.
Resources for Burn Victims
There are many organizations in the United States dedicated to helping burn survivors. Please visit our resources for burn victims web page with links to websites that have information relevant to individuals and families of those who suffered burns and other catastrophic fire injuries.
