Viplex 4000 Windows Complaints and Lawsuit
The national law firm of Lieff Cabraser Heimann & Bernstein, LLP, has filed a consumer protection class action lawsuit against Viplex Industries, Inc., which markets and sells Viplex glass panes and windows, and Atrium Corporation, Inc., which does business in California as Atrium Door and Window Company, and allegedly supplies windows to Viplex Industries, Inc. The suit is on behalf of consumers and homeowners in California who presently own homes equipped with Viplex 4000 windows.
The consumers charge that defendants have misrepresented the energy efficiency of Viplex windows by, for example, allegedly overstating the margin by which Viplex 4000 windows exceed government energy efficiency standards, such as the California "Energy Star" standard.
The suit also alleges that while Viplex touts the "safety" and "security" of the Viplex 4000 windows, it fails to disclose that certain windows, when installed in bedrooms, are too small and fail to comply with the Uniform Building Code safety requirements for ingress/egress from a bedroom windows. The purpose of the Uniform Building Code requirements for bedroom windows is to ensure, in the event of a fire or emergency, that occupants can exit and firefighters carrying airpacks can enter.
