Issue: Unauthorized debt collection phone calls
Lieff Cabraser represents individuals in a class action lawsuit against TD Auto Finance, LLC, charging that the company makes repeated, automated debt collection calls to their cell or mobile phone without their express consent. The individuals receiving the prerecorded, harassing phone calls are not customers of TD Auto Finance. Instead, they are family members, partners, or friends of persons who allegedly owe a debt to TD Auto Finance. In one case, the complaint charges, the harassment became so extreme — repeated calls for over a year — that the plaintiff changed her phone number in an effort to avoid the calls.
Fortunately, the Telephone Consumer Protection Act, a federal statute, prohibits abusive telephone practices by lenders, marketers, and other companies and places strict limits on the use of automated prerecorded calls or text messages to cell phones. “Nobody should be subjected to repeated, intrusive autodialer calls or texts at all hours from a debt collector, lender, or other company, especially on their cell phones,” stated Lieff Cabraser attorney Jonathan D. Selbin.
