As reported by Law360 (subscription), an Illinois state appellate panel has upheld an earlier decision by a trial judge to deny Hyatt Hotel Corp’s attempt to dismiss a lawsuit brought by Lieff Cabraser and co-counsel on behalf of woman who alleges she was sexually assaulted during her stay at Grand Hyatt Istanbul. The panel said that both public and private interests favor keeping plaintiffs’ claims in Cook County.

The lawsuit claims that the plaintiff, designated as Jane Doe, wanted to stay in “a well-known, respectable American hotel chain” while she visited Turkey, an unfamiliar country, and chose to stay at Grand Hyatt Istanbul specifically because of how Hyatt advertised and represented its safety. Doe alleges that she was sexually assaulted by a Gaia Spa massage therapist during her stay at the hotel in 2014.
