Rachel Geman Appointed Co-Lead Class Counsel in Nationwide Consumer Rights Class Action Against Mortgage Loan Servicer SPS

On September 3, 2026, Judge Pamela K. Chen of the U.S. District Court for the Eastern District of New York appointed Lieff Cabraser partner Rachel Geman as Co-Lead Class Counsel in Evans v. Select Portfolio Servicing, Inc.

The lawsuit alleges that mortgage loan servicer Select Portfolio Servicing, Inc. (“SPS”) improperly charged a variety of unfair and unlawful fees to borrowers with residential mortgage loans, including “pay-to-play” fees, excessive property-inspection fees, and certain late fees. More specifically, plaintiffs allege that SPS charged property-inspection fees exceeding the amounts charged by inspection vendors, imposed fees for inspections that did not find properties vacant or abandoned, and charged fees shortly after borrowers contacted SPS or promised to make a payment.

The Court certified a nationwide class asserting claims under the Fair Debt Collection Practices Act, a nationwide breach of contract class, and an alternative multistate class asserting claims for breach of the implied covenant of good faith and fair dealing.
