NAND Flash Memory Antitrust Investigation
Lieff Cabraser Heimann & Bernstein LLP is investigating suspected anticompetitive conduct by SK Hynix, Micron, Kioxia, SanDisk, and Samsung in the U.S. market for NAND flash memory. NAND flash memory is a type of storage used in cameras, laptops, smartphones, and portable storage that can retain and preserve data even without power.
Evidence suggests these manufacturers may have used public statements to coordinate supply restrictions beginning in 2023, including forward-looking statements by Micron CEO Sanjay Mehrotra predicting industry-wide reductions in capital investment and utilization rates, and Western Digital (then-owner of SanDisk) statements signaling production restraint alongside public disclosure of its planned NAND spending.
These communications preceded significant declines in industry capital expenditures and NAND supply.
