Lucas Issacharoff is of counsel in Lieff Cabraser’s New York office.
Civil Frauds matters include:
- United States v. Omnicare, 15 Civ. 4179, a False Claims Act suit against Omnicare for dispensing drugs without valid prescriptions, which resulted in a four-week trial at which a jury found Omnicare liable for $136 million in single damages resulting in a total award of $949 million; and
- United States v. Gilead Life Sciences, 16 Civ. 6228, an investigation into allegations that Gilead violated the Anti-Kickback Statute and the False Claims Act in its physician speaker program, which resulted in a $202 million settlement.
Other significant matters include:
- Arguing five appeals at the Second Circuit on constitutional and statutory issues;
- Defending the United States against constitutional and statutory challenges to federal laws and programs, including Second Amendment challenges to federal firearms laws and APA challenges to actions by the Environmental Protection Agency, the NOAA, and the Commerce Department;
- Opening an investigation and issuing a findings letter against the Mount Vernon Police Department for a pattern or practice of civil rights violations;
- Litigating FBAR and bankruptcy claims on behalf of the federal government; and
- Litigating tort and employment claims against federal agencies and grantees.
