Discover Merchant Overcharges
Lieff Cabraser serves as co-class counsel in Capp, Inc. et al. v. Discover Financial Services and Lemmo’s Pizzeria LLC et al. v. Discover Financial Services, a consolidated class action on behalf of small merchants and other businesses that are alleged to have incurred fee overcharges when Discover misclassified certain credit card transactions over the course of approximately 17 years.
In 2025, the parties reached a class-wide settlement, pursuant to which Discover agreed to pay at least $540 million, and up to more than $1.2 billion, to reimburse merchants and other business for the alleged overcharges.
