Diverse Coalition of Jurisdictions Says President Trump’s Executive Order Threatening Withholding of Funds is Unconstitutional

SAN FRANCISCO, CA — (BusinessWire) —Forty-eight cities and counties across the country are asking a federal court to reject the Trump Administration’s efforts to dismiss cases seeking to halt President Trump’s Executive Order that threatens the withdrawal of federal funds from so-called “sanctuary jurisdictions.”  The coalition filed an amicus brief in San Francisco federal court today to support the cases filed by the County of Santa Clara and the City and County of San Francisco, explaining that the Executive Order is unconstitutional and that the public will suffer irreparable harm unless the court leaves its preliminary injunction in place.  The cases, County of Santa Clara v. San Francisco Federal Judge Grants Nationwide Preliminary Injunction Stopping Enforcement of Executive Order Against “Sanctuary Jurisdictions”

In January and February of 2017, the City and County of San Francisco (California) and the County of Santa Clara (California) filed lawsuits to stop enforcement of President Trump’s executive order threatening the withdrawal of federal funds from so-called “sanctuary jurisdictions.” These complaints were ultimately supported by 36 cities and counties in California and across the country, from Jersey City to New Orleans to Seattle, and all parts in between. On April 14, 2017, the Court heard arguments on the Plaintiffs’ request for a preliminary injunction against the executive order as unconstitutional and harmful to the public nationwide. On April 25, 2017, Judge William H. Orrick of the United States District Court for the Northern District of California granted the Plaintiffs’ request and issued a nationwide preliminary injunction stopping enforcement of the executive order against jurisdictions deemed sanctuary jurisdictions. Los Angeles Opposes Trump Withholding Federal Money from Sanctuary Cities

As reported by the Los Angeles Daily News, Los Angeles is one of 36 jurisdictions that filed brief in federal court in San Francisco on Wednesday opposing an executive order threatening to keep federal funds away from sanctuary cities. San Francisco has a pending lawsuit that challenges the constitutionality of Trump’s intended financial punishment of cities that fail to fall into lockstep with a federal immigration crackdown. A similar brief was filed a week earlier by a similar group of affected jurisdictions in support of a lawsuit filed by Santa Clara on the same issue. [Read more…]
