In two related cases in the E.D.N.Y, plaintiffs allege that SPS charges or gives itself the right to charge a variety of fees that are unfair and unlawful, including “pay to pay” fees, excessive inspection fees, and certain late fees. The claims arise under federal and state Fair Debt Collection Practices Acts, common-law contract and good faith, and other. The cases are in the class certification phase, with certain claims resolved.
