As reported by Law.com (subscription), a diverse set of nearly 50 lawyers have submitted proposals to lead the national multidistrict Juul e-cigarette fraud and injury litigation. Plaintiffs Seek Relocation for Gilead Sciences Inferior HIV Drugs Trial

In lawsuits against pharma giant Gilead Sciences, plaintiffs across California allege they suffered ill effects from HIV drugs made and distributed by Gilead that were more harmful derivatives than other drugs the company had created but not sold until its stock of the inferior drugs was exhausted. As reported by the Daily Journal (subscription), attorneys for some of those plaintiffs are asking the judge to switch the case to a venue and location that would be more reachable and meaningful than the current Santa Clara County location. In an earlier tentative ruling, California Superior Court Judge Kenneth R. Freeman proposed that the 19 consolidated personal injury lawsuits be tried in Santa Clara County. Alternative venue suggestions include Alameda, San Francisco and Los Angeles counties. [Read more…]

Lieff Cabraser Files Lawsuit on Behalf of Teen Who Suffered Massive Stroke From Juul Vaped Tobacco Products

Lieff Cabraser has filed a lawsuit against Juul Labs in California Superior Court on behalf of Maxwell Berger, a 22-year-old who suffered a massive hemorrhagic stroke in July 2017 after becoming addicted to the company’s vaped tobacco products as a teenager. As a result of the stroke, Berger stayed over 100 days in the hospital and required three separate brain surgeries. Forbes notes that the lawsuit puts forth claims that Berger was left with “catastrophic and permanent injuries, such as left side paralysis, speech impairment and a 50% loss of vision from both eyes.” At the time of the incident, he was consuming two Juul-pods per day, the equivalent of smoking four full packs of old-style cigarettes. This case marks the first time the e-cigarette company has been sued over an injury this severe. [Read more…]

On Wednesday June 5, 2019, Prelude Fertility Inc., the parent company of San Francisco-based Pacific Fertility Center, asked U.S. Magistrate Judge Jacqueline Scott Corley to dismiss the proposed class action lawsuit accusing Pacific Fertility of negligently allowing patients’ stored eggs and embryos to be destroyed in a cryogenic tank failure. The defendants seek dismissal of the suit on procedural grounds, that the patients improperly lumped claims together in the suit against it and a related but separate entity, Pacific MSO LLC.
