Lieff Cabraser partner Rachel Geman has written a piece for the American Constitution Society for Law and Policy (ACS) titled “Supreme Court Deals Blow to Employees Hoping to Hold Employers Accountable.” In the piece, Geman challenges the wisdom of the recent 5-4 Supreme Court ruling in Epic Systems Corp. v. Lewis, where Justice Gorsuch’s majority opinion held that employees’ rights to cooperate in concerted activities under the National Labor Relations Act (NLRA) does not extend to participation in class and collective actions, substituting unfair forced arbitration for the right to have a case heard in open court. Lieff Cabraser Authors Amicus Brief Urging Rehearing in Ahearn V. Hyundai and Consumer Class Action Settlements

Three organizations joined the Impact Fund in filing an amicus brief with the Ninth Circuit urging reconsideration of a divided panel opinion in Ahearn v. Hyundai that overturned precedent and created a circuit split over the question of whether variations in state consumer laws can preclude national class action settlements. Media giant Bloomberg is starting a new podcast entitled “The Pay Check,” focusing on gender pay disparaties and their persistence in the workplace. Styled as an in-depth miniseries, the programs will also examine “the human toll of getting paid less for the same work.” The first episode of this new podcast series includes a discussion of Chen-Oster v. Goldman Sachs, wherein Lieff Cabraser serves as Co-Lead Counsel for plaintiffs in a gender discrimination class action lawsuit against Goldman Sachs alleging Goldman Sachs has engaged in systemic and pervasive discrimination against its female professional employees in violation of Title VII of the Civil Rights Act of 1964 and New York City Human Rights Law. As highlighted in a feature article in Bloomberg Businessweek, a federal judge in New York recently ruled that a former vice president of Goldman Sachs and three other women can now represent as many as 2,300 other current and former Goldman Sachs employees over claims of systemic gender discrimination at the global investment banking giant. After 13 years, dozens of lawyers, and more than 580 docket entries, Cristina Chen-Oster’s case finally won class action status in the Goldman Sachs gender discrimination lawsuit.
