The City of Miami obtained a significant victory in the Eleventh Circuit in Fair Housing Act lawsuits it has brought against certain banks, including Wells Fargo & Co. and Bank of America. The Eleventh Circuit issued decisions on remand from the Supreme Court on proximate cause, holding “[c]onsidering the broad and ambitious scope of the FHA, the statute’s expansive text, the exceedingly detailed allegations found in the complaints, and the application of the administrative feasibility factors laid out by the Supreme Court in Holmes v. Lieff Cabraser partner Rachel Geman has written a piece for the American Constitution Society for Law and Policy (ACS) titled “Supreme Court Deals Blow to Employees Hoping to Hold Employers Accountable.” In the piece, Geman challenges the wisdom of the recent 5-4 Supreme Court ruling in Epic Systems Corp. v. Lewis, where Justice Gorsuch’s majority opinion held that employees’ rights to cooperate in concerted activities under the National Labor Relations Act (NLRA) does not extend to participation in class and collective actions, substituting unfair forced arbitration for the right to have a case heard in open court. The U.S. Supreme Court has upheld a lower court decision in favor of employees at Tyson Foods Inc. that included a $5.8 million award in their favor in a pay dispute over previously unpaid time spent by workers putting on and taking off protective work clothes and equipment. Tyson argued that the employees do their jobs when they are on the slaughter and/or processing floors, and not while preparing for that work. [Read more…]

Lieff Cabraser attorney Rachel Geman will be participating at the National Employment Lawyers Association (NELA) 2015 Annual Convention on June 26, 2015 in Atlanta, Georgia. Geman will moderate and speak at a panel discussion titled “Statistics For Lawyers – Even Those Who Hate Math,” which will address issues that arise in Fair Labor Standards Act and Title VII class action cases in regard to statistical analyses and representative testimony at trial.
Earlier this year, the U.S. Senate approved and sent to the House of Representatives the Thune-Nelson Motor Vehicle Safety Whistleblower Act. The bill offers individuals a substantial monetary incentive for whistleblowers in the automotive industry to report safety problems and vehicle defects that could lead to serious injuries or death. Whistleblowers could receive up to 30 percent of any monetary penalty over $1 million imposed by the U.S. Department of Transportation or U.S. Department of Justice for misconduct.
